The Service

By subscribing to or otherwise using the Guber jokes service (the “Service”), you agree to be bound by these Terms + Conditions (the “Terms”).

Website Owner’s Name

Guber (“Guber”) is a mark owned and operated by ENCSquared, LLC (“ENCSquared”), a New York–based limited liability company, and is the provider of the Service described herein.

Agreement to Receive Messages (SMS and WhatsApp)

By providing your mobile phone number and/or opting in via WhatsApp at sign-up, you expressly consent to receive communications from Guber via:

• SMS (text messages), and/or

• WhatsApp messaging,

containing jokes, service-related notifications, account information, surveys, and other communications related to the Service.

You may elect your preferred delivery method(s) at sign-up. Message content may be delivered via one or more of these channels depending on your selections. Guber does not send unsolicited messages.

Message Frequency and Timing

Free Service:

You will receive one joke every Monday morning (after 8:00 a.m. local time).

Paid Subscription Service:

You will receive one joke each weekday morning (after 8:00 a.m. local time), excluding U.S. national holidays.

Message frequency may vary occasionally due to holidays, service updates, or operational considerations.

Opting Out

You may opt out of receiving messages at any time.

• SMS: Text STOP to 1-833-455-2972.

• WhatsApp: Use the opt-out or unsubscribe mechanism provided within the WhatsApp conversation or follow instructions provided in-message.

After opting out, you may receive a final confirmation message. Opting out of messages does not automatically cancel a paid subscription or prevent auto-renewal (see “Subscription Service and Auto-Renewal” below).

Message and Data Rates

Message and data rates may apply depending on your carrier or messaging provider. Guber is not responsible for any charges imposed by your carrier or WhatsApp.

Participating Carriers and Geography

The Service is available to users in the United States through major wireless carriers, including but not limited to AT&T, T-Mobile®, Verizon Wireless, and others. WhatsApp availability is subject to WhatsApp’s own platform requirements and policies.

Participation Requirements

To use the Service, you must:

• Be at least eighteen (18) years old;

• Have a mobile device capable of receiving SMS and/or WhatsApp messages; and

• Be authorized to use the phone number or WhatsApp account you provide.

Original Content

All content provided by Guber is original or properly licensed. Guber makes reasonable efforts to ensure that all content distributed through the Service is unique, human written (i.e. no Artificial Intelligence) and appropriately sourced.

Changes to or Termination of the Service

Guber reserves the right to modify, suspend, or terminate the Service (in whole or in part) at any time, with or without notice.

Data Collection and Usage

By using the Service, you consent to the collection and use of information including, but not limited to:

• Your mobile phone number and/or WhatsApp account identifier;

• Carrier or messaging service information;

• Message interaction data; and

• Payment and subscription status.

This data is used to operate, maintain, and improve the Service. Guber does not sell or rent personal data to third parties.

Third-party service providers (such as messaging platforms and payment processors) may process limited data solely as necessary to provide their services to Guber.

Analytics and Cookies

Guber uses a website analytics service to collect basic usage statistics and understand how users interact with the website.

Guber does not use advertising cookies or third-party tracking cookies beyond analytics and essential service functionality. Payment processing providers (such as Stripe) may place cookies or similar technologies on your device as required to process transactions securely.

Use of analytics and cookies is limited to lawful, industry-standard purposes and does not constitute the sale or sharing of personal data for advertising purposes.

Indemnification

By using the Service, you agree to indemnify and hold harmless Guber and ENCSquared from any claims, damages, losses, liabilities, or expenses arising out of your use of the Service, including failure to maintain an accurate phone number or messaging account.

Disclaimer of Liability

The Service is provided on an “as is” and “as available” basis. Guber is not liable for any damages arising from the use of the Service, including message delivery failures, delays, errors, or interruptions.

User Conduct

Users may not use the Service for abusive, unlawful, or offensive purposes. Violation of this provision may result in immediate termination of access without notice.

Intellectual Property Rights

All content delivered through the Service is the property of Guber and is protected by applicable copyright and trademark laws. When sharing content, attribution to Guber is required.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any disputes shall be brought exclusively in the state or federal courts located in New York.

External Links

The Service may include links to third-party websites. Guber is not responsible for the content or practices of those sites.

Right to Refuse Service

Guber reserves the right to refuse or discontinue Service to any user at any time for any reason.

Subscription Service and Auto-Renewal

Paid subscriptions are billed annually and processed through Stripe.

By purchasing a paid subscription, you agree that:

• Your subscription term is one (1) year;

• Your subscription will automatically renew for successive one-year terms at the then-current rate unless you cancel before renewal; and

• Your payment method will be charged automatically at renewal.

No refunds or prorated credits will be issued for partial subscription periods, including if you opt out of receiving messages before the end of a term and including if Guber terminates your service at its reasonable discretion.

Miscellaneous

By using the Service, you represent that you have the authority to agree to these Terms. If any provision is found unenforceable, the remaining provisions remain in effect. Continued use of the Service constitutes acceptance of any updated Terms.
